Information and purposes

We receive names, contact details, messages and property preferences that you provide through forms, email, telephone or social media. We use them to respond, arrange viewings, identify suitable properties and manage buyer or vendor instructions. If you become a client, we may also require identity, ownership, transaction and financial information necessary for the instruction and legal checks. Site operation also involves device, connection and security information. Optional cookies are explained separately.

Legal bases and required information

Enquiries and representation rely on steps taken at your request before a contract and performance of a contract (GDPR Article 6(1)(b)). Accounting, tax and anti-money-laundering duties rely on legal obligations (Article 6(1)(c)). Optional marketing and non-essential cookies rely on consent (Article 6(1)(a)); an enquiry is not marketing consent. Security, fraud prevention and handling legal claims rely on our legitimate interests (Article 6(1)(f)), balanced against your rights. Fields marked required are needed to answer your request; without them we may be unable to assist. Identification required by law is necessary to proceed with a transaction.

Recipients and international processing

Information is processed by authorised personnel and service providers, including Wix for hosting and forms, communications providers and professional advisers. We share the details necessary to arrange a viewing or transaction with relevant collaborating agencies, owners, lawyers, notaries or lenders when required by your instruction, consent or law. Competent authorities may receive information where legally required. External services such as Instagram and WhatsApp apply their own privacy policies when you use them.

Wix and its subprocessors may process information outside the European Economic Area. Wix describes the use of applicable adequacy decisions and EU standard contractual clauses, with additional safeguards where required, in its Data Processing Agreement. Retention

We keep enquiries for as long as needed to answer and follow up the request. Client and transaction records are retained for the relationship and applicable statutory or legal-claims periods; access is restricted when records are kept only to meet legal duties. Spanish anti-money-laundering documentation is retained for ten years where the obligation applies, with restricted access after five years. Optional marketing continues until you withdraw consent or object; a minimal suppression record may be kept to respect your choice. Cookie durations depend on the technology and provider.

Your rights

Email emilio@emiliomiovega.com to request access, correction, erasure, restriction or portability, or to object where applicable. You may withdraw consent at any time, without affecting prior lawful processing. We may ask for proportionate information to verify identity. We normally respond within one month; permitted extensions will be explained. You may complain to the Spanish Data Protection Agency (AEPD). We do not make decisions producing legal or similarly significant effects solely by automated processing through the website enquiry process.
